私たちはGoogleマップにより誹謗中傷や営業妨害等の被害を受けた被害者と、被害者の支援者からなる「Googleクチコミ被害者の会」と申します。お店や医療機関等は無断でグーグルマップに掲載され、匿名で個人情報やデマを含む誹謗中傷・営業妨害をされています。この無法状態を改善する活動を行っています。会長は都内の開業医です。ご賛同いただける方は誰でも参加可能です。署名サイト「Voice」で署名した人を会員とします。グーグルマップが店や医療機関等に迷惑をかけていることについて、グーグルを相手に集団訴訟を行っています。

当会の活動が表現の自由を制限するのではないかと心配されることがあります。当会は表現の自由を制限することはありません。私たちは表現の自由は最も重要なものの一つで守らなければならないと考えています。グーグルマップに虚偽の情報を書きこむことは表現の自由には該当しないばかりか、自由に書き込みができることへの脅威を人々が感じることによって表現の自由を損うおそれがあると考えています。また、グーグルマップで医療機関は守秘義務や医療広告ガイドラインなどにより反論がほとんどできない状態であるにも関わらず、匿名のユーザーが一方的な批判を書きこむことは、独裁者が一方的なプロパガンダを流すことと同じように表現の自由を損なうと考えています。これは間違った情報が人々に拡散される原因になります。そして、一方的に批判されてしまう医療従事者は委縮して自由な表現ができなくなる可能性があります。私たちはこの活動によって表現の自由を守りたいと考えています。

■ グーグルマップの問題点 (Problems with Google Maps)
グーグルマップは現在世界中で最もよく使われているインターネット上の地図の一つです。グーグルは店舗や医療機関等(以下、施設と書きます)を無断でグーグルマップに掲載しています。グーグルマップには誰でも勝手に施設の情報を変更できるようになっており、しばしば嫌がらせや営業妨害に使われています。施設管理者は施設の情報を守るためにグーグルビジネスプロフィールの登録を事実上強制されています。

大事故の背後には多くの小さな事故やインシデントがあると言われています。グーグルマップにも同様のことが言えます。極端に悪質な誹謗中傷だけを防いでも問題は解決しないと考えます。根本原因はモラルが崩壊していることにあるからです。モラルが崩壊している理由はグーグルマップの機能が出発点から間違っているからです。他人を勝手に地図に掲載して強制的にクチコミや点数評価の対象とするべきではありません。幸せな人がグーグルマップで誹謗中傷や営業妨害をすることはないでしょう。犯罪は教育だけで防ぐことはできず、環境も重要です。「嘘つきは泥棒の始まり」と言われるように、小さな罪を犯すことで人はより悪い人間へと変わってしまいます。グーグルマップは匿名で勝手に他人の点数評価やクチコミを書かせることで、不幸な人々に罪を重ねさせています。

■ Googleクチコミ被害者の会を結成するまでの経緯 (How the Google Review Victims Association was formed)
2021年に当会の代表はグーグルマップが大変危険な機能を持つことに気が付きました。自分が経営する医療機関の住所について、誰か知らない人が間違った情報を記載したためグーグルに報告したのですが、修正してもらえなかったからです。調べてみると、グーグルマップでは虚偽の誹謗中傷や営業妨害が多数行われており、あからさまな侮辱が数えきれないほど記載されているにも関わらず、グーグルは削除を拒否していることが分かりました。
In 2021, our representatives realized that Google Maps has a very dangerous function. Because a stranger listed incorrect information about the address of the medical facility owned by our representative, our representative reported it to Google, but they did not correct it. Our representative investigated and found that Google Maps has a lot of false defamation and business obstruction. 日本医師会に助けを求めたところ、多くの人々がグーグルマップのクチコミ機能の問題改善に挑戦したものの成功例はなく、グーグルの幹部から返事をもらうことすら当会の代表が初めてであることが分かりました。国会議員に助けを求めたところ、インターネットでの誹謗中傷などについて国会で法改正が検討されていますが、「表現の自由」の問題もあり時間がかかっていることが分かりました。

2023年の春に、集まった署名を意見書とともに内閣総理大臣、グーグルCEO、アルファベット創業者、アメリカ合衆国大統領に提出しました。残念ながら返答はいただいておりませんが、各界から多くのご支援をいただいております。現在、署名者は500名を超えています。厚く御礼申し上げます。引き続き署名活動は継続し、署名数が増加したら再度提出する予定です。グーグルには話し合いすらしていただけなかったことから、私たちはやむを得ずグーグルに対して集団訴訟を提起することにしました。本件の分野を専門とする弁護士の方々が顧問となり、グーグルマップによって生じた損害の賠償を求めて、グーグルに対する集団訴訟を2024年4月から開始します。今回の集団訴訟では原告団は医療機関に限定していますが、今後は全被害者によるグーグルへの集団訴訟も行う予定です。

教育機関も同様にGoogleの口コミ対応に困っています。医療機関と同様に、守秘義務があるので返信なんてできませんし、大学と異なり、情報分野に強い教職員が常駐しているとは限りませんのでビジネスオーナーとして登録することもできません。一方で、少しでも気に食わないことがあると「ネットに書き込むぞ」とすごむ保護者や生徒が近年増えていると感じています。こんなことが全国どこの学校でも増えてきて、今では情報リテラシー教育なんて教員が萎縮してしまって、とてもできていません。応援しています！

裁判に賛成です。①知り合いの個人経営の自転車屋さんをたまたまマップでみたら、何故か最悪の評価。お店に教えたら「商売敵が多いもので」と言われたが、店主の人格を中傷するような書き込みだったので疑問を持った、②サイクリングしようとルートチェックしていたら「○○解放会館」と明らかに部落施設の表示があり、興味本位で評価をみると、こちらも最悪点。ほかにも政党、寺院、宗教団体とかもあるので、たしかに腹の立つ組織もあるにはありますが、マップ上でやりあうべきではないと言う点では一致できます。法務局が介入しないのはどうかしていませんか？

弊社も勝手な解釈と一方的な感情で口コミを書かれました。
口コミの返信で真摯にこちら側の主張とともに、異論がある場合は直接の連絡を依頼したところ、口コミは削除されました。しかし、評価は星1をつけられたまま残っています。Googleに星の削除を依頼しましたが、何のレスポンスもないままです。
推測ですが、相手の口コミ履歴等を見ると同業他社と思われます。
このような状態を放置されるとGoogle自体が営業妨害をしていると感じ、憤りを感じています。医師だけではなく、弊社のように迷惑を被っている事業者は多くいると思われます。
署名にて応援させていただくとともに、医師以外でも集団提訴をするのであれば参画したいと思います。

たまに、そこを実際利用してみたら自分も不快な思いをして「普段からここはこういう所で、きっと誰もがこう思ったんだろうな」と思わせる投稿は確かにあります。
でも悪評価の多くは個人がその時不快に思ったことをもとに一方的に感情的に投稿し、「ざまあみろ」と言いたげな評価となっていることが多い。
口コミ評価なんて要りません。
ただ単に、車椅子やベビーカーが入れるかとか、おむつ交換台があるかとか、子連れでも安心かとか、子連れが多いから子どもが苦手な人はやめたほうが良いとか、そういう情報のみあれば良いです。
ずっと言われていることなのに改善されないのは職務怠慢だとおもいます。頑張って欲しい

私も何回か弁護士に相談しましたが、弁護士は全くやる気がありません。それなりにお金かかりますけど、やりますかぁ？という態度です。Googleに削除依頼をしても全く動く気はありません。
医療というのは、美容や飲食と違って、誰もが正しく評価できるものではありません。思った通りにならないからと言って平気でGoogleに誹謗中傷を書き込まれると、職員の士気にも影響します。また、自分の気に入らないことに執着して口コミを書き込むような人間には普通では考えられないような精神的な問題を抱えているような人も多く見かけます。このような口コミをこちらの意思とは関係なく表示するというのはあまりにも強権的なやり方ではないでしょうか？とにかくGoogleが大企業であるという権力をかさに着てこちらの望みもしないような口コミ投稿を強制的に表示するということには憤りを禁じえません。
ぜひ、私も原告団に加わらせていただいて裁判を戦いたいと思います。
